Terms of Service
Effective October 9, 2026
1. Agreement and eligibility
By creating an account or using babyforward.com, you agree to these Terms. If you don't agree, don't use the site.
Baby Forward is operated by Baby Forward LLC, a Kansas limited liability company ("Baby Forward," "we," "us").
You must be at least 18 years old and able to enter a binding contract to use Baby Forward.
2. Baby Forward is a marketplace, not a seller or rental company
Baby Forward provides a website where users list, buy, sell, rent, and give away used baby and children's items. Baby Forward does not own, inspect, store, clean, or deliver any item listed on the site.
Every sale or rental is an agreement directly between the users involved. Baby Forward is not a party to that agreement and is not a seller, renter, owner, agent, or guarantor of any item.
Baby Forward does not verify the identity, background, or reliability of users. We do not guarantee the quality, safety, legality, or accuracy of any listing.
3. Your account
You must give accurate information when you sign up and keep it current. You are responsible for everything done through your account, so keep your password private.
One person, one account. You may not create an account for someone else or use another person's account.
4. Fees and payments
Listing is free. Baby Forward charges fees only when a sale or rental is paid. Current fees:
| Transaction | Who pays | Fee |
|---|---|---|
| Sale | Seller | 10% of the sale price, minimum $2.00 |
| Rental | Renter | Service fee of 6% of the rent |
| Rental | Owner | 10% of each week's rent |
| Rental deposit | Renter | 3% processing fee on the deposit (non-refundable) |
| Donated item | Nobody | Free |
The minimum sale price is $3.00. Fees are shown before you list, buy, or rent. We may change fees for future transactions with notice on the site.
Payments are processed by Stripe. To receive money, sellers and owners must connect a payout account through Stripe and agree to Stripe's terms. Baby Forward does not store card or bank numbers.
When a seller or owner has not connected a payout account, Baby Forward holds the amount owed and pays it once the account is connected. We may delay a payout while a dispute is open or if we suspect fraud.
You are responsible for any taxes on money you receive through Baby Forward.
5. Buying and selling
The buyer pays at checkout. Baby Forward holds the payment until the sale is complete, then releases the seller's share.
- Buyer and seller arrange a local pickup through Messages.
- The seller marks the item as handed over.
- The buyer inspects the item and either confirms receipt or files a dispute.
- If the buyer does neither within 48 hours of the handoff, the payment is released to the seller automatically.
Inspect before you confirm. Once a buyer confirms receipt, or the 48-hour window passes, the sale is final and payment cannot be reversed through Baby Forward.
If a buyer files a dispute before confirming, Baby Forward will review it and may refund the buyer, pay the seller, or split the payment. Our decision on how held funds are released is final, but it does not limit any legal rights users have against each other.
6. Rentals
Rentals are booked by the week, for 1 to 12 weeks. The renter pays the full rent, the service fee, the deposit, and the deposit processing fee at checkout.
Owner payments. The owner is paid at the end of each rental week, minus the owner fee. When a return is confirmed, any remaining weeks are paid to the owner at that time.
Deposits. Owners set a refundable deposit of at least 50% of the item's replacement value. Baby Forward holds the deposit until the rental ends.
Early returns. Rent is not refunded for unused weeks if an item is returned early.
Returns and damage.
- The renter returns the item by the return date and requests a return on the site.
- The owner confirms the item is back. The owner may deduct up to the full deposit for damage beyond normal wear and must describe the damage.
- The renter has 48 hours after confirmation to dispute a deduction.
- If there is no dispute, the deposit minus any deduction is refunded to the renter, and the deduction is paid to the owner.
- If the owner does not respond within 3 days after the later of the return date or the renter's return request, Baby Forward may confirm the return with no deduction.
Items not returned. If an item is not returned and no return is requested within 7 days after the return date, the full deposit is paid to the owner. The renter remains responsible for returning the item. Forfeiting the deposit does not limit the owner's other legal rights.
Disputes. If a deduction is disputed, Baby Forward will review the information both sides provide and decide how the held deposit is released. Baby Forward's role is limited to releasing funds it holds. We are not responsible for an item's loss, damage, or value beyond the deposit.
Owners rent items at their own risk and should set deposits that reflect what an item would cost to replace.
7. Responsibilities and product safety
Sellers and owners agree to:
- Own the item or have the right to sell or rent it
- Describe it accurately, with real photos and an honest condition rating
- Disclose known defects, missing parts, and repairs
- Check the item against CPSC recalls (cpsc.gov/Recalls) before listing
- For car seats, disclose the expiration date and whether the seat has ever been in a crash
Buyers and renters agree to: inspect items before confirming receipt, follow the manufacturer's instructions, and check recalls before use. Used baby gear carries risk, and you use any item at your own risk.
Recall screening. Baby Forward may automatically compare new listings with CPSC recall information. This is a convenience only. It does not catch every recall, and it does not mean an item is safe.
8. Prohibited items and conduct
You may not list:
- Recalled items, unless the recall remedy has been completed and is disclosed
- Car seats that are expired, have been in a crash, or are missing parts or labels
- Drop-side cribs, crib bumpers, inclined infant sleepers, or any product banned from sale under federal law
- Breast milk, opened formula or food, medication, or used items meant to go in a child's mouth that cannot be sanitized
- Stolen, counterfeit, or illegal items
You may not:
- Arrange to pay or be paid outside Baby Forward for an item found on Baby Forward
- Post false or misleading listings, reviews, or messages
- Harass, threaten, or discriminate against other users
- Use the site for fraud or to collect other users' personal information
- Interfere with the site's operation or security
We may remove listings, cancel transactions, or suspend accounts that break these Terms.
9. Meeting in person
Pickups and returns happen in person, arranged by the users. Baby Forward does not attend, supervise, or screen these meetings.
Meet in a public place or another location you are comfortable with, and bring someone along if you prefer. You are responsible for your own safety, and Baby Forward is not liable for anything that happens during a meetup.
10. Disclaimers, limits of liability, and indemnity
No warranties. The site and every item listed on it are provided "as is." To the extent the law allows, Baby Forward disclaims all warranties, including merchantability, fitness for a particular purpose, and safety of any item.
Limit of liability. To the extent the law allows, Baby Forward is not liable for indirect, incidental, or consequential damages, or for injury, loss, or damage caused by any item or any user. Baby Forward's total liability for any claim is limited to the greater of the fees you paid Baby Forward in the 12 months before the claim or $100.
Indemnity. You agree to cover Baby Forward's losses and reasonable legal costs from claims arising out of your listings, your items, your transactions, your meetings with other users, or your breach of these Terms.
11. Disputes, changes, and contact
Disputes between users should be worked out between the users first. Baby Forward may help but is not obligated to resolve them, except for deciding how funds it holds are released.
Governing law. These Terms are governed by the laws of the State of Kansas. Any legal action against Baby Forward must be brought in the state or federal courts located in Johnson County, Kansas.
Changes. We may update these Terms. We will post the new version on the site with a new effective date. Continuing to use Baby Forward after that means you accept the changes.
Ending your account. You may close your account at any time. We may suspend or close accounts that break these Terms. Open transactions will be completed or refunded as these Terms describe.
